General terms of service
Rental Terms & Conditions
Please note: Boat bookings are made through the Holidoit platform, which manages the purchase contract and payments in accordance with its own Terms and Conditions. The present document governs the operational rental service provided by us.
1. The service
Telos di Massimiliano Ortelli (hereinafter "the Operator") provides customers with motorised 40 hp self-drive boats for rental without a skipper on Lake Como, Italy.
The service is available upon prior booking through the Holidoit platform or, subject to availability, by contacting the Operator directly.
2. Booking and payment
Bookings are made through the Holidoit platform. By completing the purchase process, the customer accepts Holidoit's Terms and Conditions as well as these operational terms.
- A booking confirmation will be sent by email from Holidoit.
- A deposit is required at the time of booking and is processed through the Holidoit platform using the payment methods it accepts.
- The remaining balance is paid directly to the Operator at the embarkation point on the day of the rental, before the vessel is handed over.
- The Operator will contact the customer before the rental date to confirm operational details and advise on the payment methods accepted for the balance.
3. Cancellation and refunds
The cancellation and refund policy is the one set by Holidoit at the time of booking and stated in the voucher received. As a general guide:
- Free cancellation up to 48 hours before
- No-show or same-day cancellation: no refund
In the event of adverse weather conditions making navigation impossible or unsafe (at the Operator's sole discretion), the rental will be rescheduled or fully refunded.
4. Requirements for self-drive rental
To rent a boat without a skipper, the customer must:
- Be at least 18 years of age and present a valid identity document.
- Not be under the influence of alcohol, narcotics or any medication that impairs the ability to operate a vessel.
The Operator reserves the right to refuse handover of the vessel if the customer does not meet the above requirements. No refund will be issued in the event of false declarations made at the time of booking.
5. Vessel handover
Handover takes place at our boarding point in via Regina 134 - Brienno (Como) at the agreed time. Customers must arrive at least half an hour early: late arrival does not entitle the customer to an extension of the rental period.
At the time of handover, the Operator will conduct a mandatory briefing covering:
- How to operate the vessel and safety equipment
- Navigation limits permitted on Lake Como
- On-board conduct rules
- The Operator's emergency contact number
The customer signs a handover receipt confirming the vessel is in good condition.
6. Navigation rules and customer obligations
The customer agrees to:
- Comply with Italian nautical regulations and lake navigation signage.
- Not exceed the maximum number of persons on board as stated in the vessel's registration certificate.
- Navigate exclusively within the authorised area of Lake Como; leaving the lake is strictly prohibited.
- Maintain a safe distance from other vessels, jetties, swimming areas and restricted zones.
- Not sub-let or transfer the vessel to third parties.
- Contact the Operator immediately in the event of a breakdown, accident or dangerous situation.
- Return the vessel in the same condition as received.
7. Damage and liability
The customer is responsible for any damage caused to the vessel, engines and on-board equipment during the rental period, except for pre-existing defects documented at handover.
The vessel is covered by third-party liability insurance (RCT). Damage to the vessel itself (hull, engine) is the customer's responsibility in accordance with the Operator's insurance conditions.
The Operator is not liable for injury to persons or damage to property resulting from improper use of the vessel, failure to comply with navigation rules, or weather conditions arising during the rental period.
8. Safety on board
The vessel is equipped with the life-saving and safety devices required by applicable law. The customer must verify their presence and condition at handover. The use of a life jacket is recommended for all persons on board.
9. Amendments to these terms
The Operator reserves the right to amend these terms and conditions. Any changes will be published on this page with an updated date and will apply to bookings made thereafter.
10. Governing law and jurisdiction
These terms are governed by Italian law. Any dispute shall be subject to the exclusive jurisdiction of the Court of Como, except where the customer qualifies as a consumer under Italian Consumer Code (Legislative Decree 206/2005), in which case the court of the consumer's place of residence or elected domicile shall have jurisdiction.
Customers resident outside Italy are advised that EU consumer protection regulations may also apply, including Regulation (EU) No 524/2013 on online dispute resolution. The EU ODR platform is accessible at: ec.europa.eu/consumers/odr.
